Auction Terms & Condtions

1. Auto Auctioneers (Hamilton) Limited is a public auction and everyone is welcome to bid.
2. To bid we require that you register at the office or online to receive a copy of the auction terms and conditions and a bidder’s number. ID is required for registration.
3. Auto Auctioneers and/or the Auctioneer will publish, display or announce clearly whether the vendor is in trade as a supplier (within the meaning of the Consumer Guarantees Act 1993) prior to and during the auction.
4. Vendor bids are not allowed at Auto Auctioneers.
5. Unless stated otherwise by notice or by the Auctioneer, all goods offered for sale by auction are subject to a reserve price. The Auctioneer will indicate when the reserve is reached and at the fall of the hammer the top bidder will be the new owner of the vehicle.
6. The Buyer acknowledges and agrees that the Buyer has not relied upon any representation made by the vendor or Auto Auctioneers and has undertaken their own independent inquiries into the goods. Pre-purchase inspections are encouraged.
7. The warrant of fitness status of any vehicle is clearly stated on the CIN and by the Auctioneer. If the warrant is more than one month old the Buyer will acknowledge this in writing. If the warrant has expired the Buyer will sign that they will not operate the vehicle except for the purpose of obtaining a new warrant of fitness.
8. If the bidding does not reach the reserve price the vehicle will be passed in and the top bidder will have first right to negotiate. If the vehicle has not been successfully negotiated after one hour after the end of the auction, the vehicle can be negotiated by anyone else who attended the auction and sold under auction terms up to the end of the next business day.
9. Terms are STRICTLY cash or cleared funds. A non-refundable deposit of $500 is required at the fall of the hammer with the balance to be paid by 11 am the following business day, unless other payment arrangements are made with approval of the management of Auto Auctioneers. Credit card payments incur a 2.5 % surcharge.
10. A BUYER PREMIUM will be charged on all vehicles sold as follows:
    1. $200 (incl. gst) on purchases – up to $1999
    2. $350 (incl. gst) on purchases - $2000 to $7999
    3. $450 (incl. gst) on purchases - $8000 to $14,999
    4. $500 (incl. gst) on purchases - $15,000 and above.
11. If a dispute arises over the sale of a vehicle, the vehicle will be re-offered for sale. THE AUCTIONEER’S DECISION IS FINAL.
12. Anyone found dealing outside the sale will be barred from the premises. NO EXCEPTIONS.
13. As a warning to unregistered traders: unregistered trading is an offence punishable by law. Auto Auctioneers (Hamilton) Limited is required to make all records available to the Police.
