Auction Rules

1. Auto Auctioneers (Ham) Ltd is a public Auction and everyone is welcome to bid.
2. To bid we require that you register at the office to receive instructions on the sale and a bidders number.
3. All vehicles offered are sold on an "as is, where is" basis without any warranty expressed or implied as to their condition, mileage or fitness for any purpose. Auto Auctioneers Ltd do not guarantee the odometer reading of any vehicle as it is represented by the owner and is up to you to ascertain the true mileage.
4. Auto Auctioneers Ltd will endeavour to represent the vehicle as accurately as possible from the information supplied but it is your responsibility to be satisfied with the details before the purchase and Auto Auctioneers accepts no responsibility whatsoever for the accuracy of this information.
5. If the vehicle has had a new warrant of fitness within the last 28 days this goes with the vehicle. If the warrant is older than 28 days the purchaser is required to sign a form to indicate that the vehicle will only be used to obtain a new warrant of fitness.
6. BIDDING: Please make your bids clear with a hand signal. Bids will be taken in $200, $100 and $50 sums. Only fair and competitive bidding is permitted.
7. Most vehicles are subject to a reserve price. This figure is confidential before the Auction. When bidding reaches the reserve price the "NOW SELLING" sign will light up. At the fall of the hammer the top bidder will be the new owner of the vehicle.
8. If the bidding does not reach the reserve price the vehicle will be knocked down and the Auctioneer will announce "We will negotiate with you" the top bidder after the auction. If the vehicle has not been successfully negotiated by 8 pm the top bidder loses their rights and the vehicle can be sold to another bidder or be re-offered at the next auction.
9. Terms are STRICTLY cash. A cash deposit of a)$200 for vehicles with a purchase price of less than $2000.00 or b)$400 for vehicles with a purchase price of $2000.00 or more is required at the fall of the hammer and the balance to be paid in cash or by bank cheque or EFTPOS by 11 am the following business day. Credit cards will be accepted for the deposit but not for the balance of any transaction. Any deposit is non refundable should the purchase not be completed.
10. A BUYER PREMIUM fee of
      a) $150(inc GST) on purchases up to $1999.00 or
      b) $250(inc GST) on purchases $2000.00 and over
    will be charged on all vehicles sold. This premium includes the cost of Change of Ownership and guarantees the purchaser Title to the vehicle on the following basis: If at any time within the six months following purchase it is established that the vehicle was at the time of sale encumbered and/ or the vendor did not have title to or was not entitled to sell the vehicle, Auto Auctioneers Ltd as its sole option will either take such steps to give clear title to the vehicle or it will refund the purchase price.
11. If a dispute arises over the sale of the vehicle, the vehicle will be re-offered for sale. THE AUCTIONEERS DECISION IS FINAL.
12. Anyone found dealing outside the sale will be barred from the Auction. NO EXCEPTIONS.
13. As a warning to unlicensed traders: Unlicensed trading is an offence punishable by law. Auto Auctioneers Ltd is required to make all records available to the Police.
